Terms of Service

JustPlaneHosting (“JPH,” “we,” “us,” or “our”) is a service of Climb and Maintain, SPC, a Washington social purpose corporation.

These Terms of Service (“Terms”) govern your purchase and use of website hosting, virtual-airline hosting, prepaid Technical Management, separately scoped technical work, and related services from JustPlaneHosting.

By ordering, accessing, or continuing to use a JPH service, you agree to these Terms, our Acceptable Use Policy, and our Privacy Policy.

1. Eligibility and Accounts

You must be at least 18 years old, or otherwise legally able to enter into a binding contract, to purchase JPH services.

2. Services

The exact features, limits, management level, storage, bandwidth, software, and other resources included with your service are described on the applicable order or product page.

Hosting and Technical Management are separate services unless an order specifically says otherwise.

VA Hosting includes the normal initial phpVMS provisioning described on the applicable product page. Ongoing configuration changes, troubleshooting, routine maintenance, and other technical work are not included merely because a customer has a hosting subscription.

Technical Management is prepaid, nonrenewing technical assistance for the supported stack during the purchased service period. Its scope may include supported configuration changes, troubleshooting, routine maintenance, phpVMS assistance, and server-side support as described when purchased.

Technical Management does not include unlimited development, custom programming, content creation, graphic design, support for every third-party product, or work unrelated to the supported service. Larger migrations, development work, repairs, integrations, and other projects may be separately scoped and quoted before billable work begins.

We may make reasonable technical changes to our hosting environment when necessary for security, reliability, compatibility, upstream-provider requirements, or continued operation of the service.

3. Third-Party Infrastructure and Software

JPH relies on third-party infrastructure, networks, software, payment processors, domain services, and other service providers.

Your use of JPH services must therefore also comply with any restrictions imposed on us by our infrastructure or service providers.

We may need to modify, restrict, suspend, or discontinue a particular feature when required by an upstream provider or when continuing to offer that feature would create a security, legal, or operational problem.

Third-party applications such as content-management systems, virtual-airline software, plugins, themes, and other customer-installed or customer-selected software may have their own licenses and terms.

Unless a JPH service specifically says otherwise, JPH does not warrant the availability, security, compatibility, or continued development of third-party software.

4. phpVMS Modules, Add-ons, and Custom Code

JPH supports the phpVMS core application to the extent included with initial VA Hosting provisioning, an active Technical Management service period, or a separately agreed project scope. Modules, add-ons, themes, integrations, and other custom code may change the behavior of phpVMS and are subject to the terms below.

Third-Party Modules and Add-ons

Customers may install third-party phpVMS modules and add-ons from identifiable developers or projects with a reasonable public source, documentation, or support presence.

JPH does not provide support for third-party modules themselves and does not guarantee their compatibility, security, continued maintenance, or operation with any particular version of phpVMS, PHP, or other software.

If a third-party module damages or prevents normal operation of a phpVMS installation, JPH may assist with diagnosis, removal, rollback, repair, or reinstallation. Work outside an active Technical Management service period or separately agreed project scope may be separately quoted and billable.

Customer-Created Modules and Custom Code

Customers may create and install their own modules, add-ons, themes, integrations, and other custom code. This includes code created with AI tools or by a developer or contractor selected by the customer.

Customer-created code is installed and operated at the customer's responsibility. JPH does not provide debugging or development support for customer-created code unless separately agreed.

If customer-created code damages or prevents normal operation of a phpVMS installation, assistance with diagnosis, removal, repair, data recovery, or reinstallation may be separately quoted and billable unless it falls within an active Technical Management service period or other agreed scope.

JustPlaneHosting Custom Modules

JPH offers custom phpVMS development on a per-project basis. A custom-development project may include development, testing, installation, and defined post-installation support as stated in the applicable project quote or agreement.

If an unmodified JPH-developed module causes the supported phpVMS installation to fail, JPH will repair or remove the module and restore the affected phpVMS installation, up to and including a clean phpVMS reinstall when necessary, without additional repair labor charges.

This coverage does not apply to problems caused by customer modifications, unrelated third-party software, unsupported software upgrades or combinations, server changes outside JPH's control, or use of the module outside its agreed scope.

Custom-development pricing, ownership or licensing, supported phpVMS versions, future feature work, compatibility updates, and any ongoing maintenance terms will be stated in the applicable project quote or agreement.

5. Billing and Automatic Renewal

Hosting services are billed according to the billing period selected when you order. JPH storefront payments and recurring hosting subscriptions are processed through Stripe.

Stripe may store the payment method associated with a recurring hosting subscription and provides the hosted Customer Billing portal used to view invoices, update payment information, and manage recurring hosting billing.

Unless the order specifically states otherwise, recurring hosting services automatically renew at the end of each paid billing period using the payment method associated with your account.

The price and billing frequency are displayed before purchase.

You may cancel recurring service at any time before the next renewal to prevent future charges.

We will not intentionally use hidden enrollment, pre-checked subscription options, or deliberately obscure cancellation procedures.

Taxes, where required, may be added to the listed price or included in it, depending on the product. Checkout will show the applicable tax treatment and total before purchase.

Prepaid Technical Management and Sponsorships

Technical Management is prepaid and does not automatically renew. Purchasing more than one month prepays multiple Technical Management service periods; it does not convert Technical Management into a recurring hosting subscription.

A Sponsor a VA purchase buys prepaid Technical Management for the identified recipient virtual airline. Sponsorship does not transfer ownership, administrative control, account credentials, or other rights in the recipient's hosting service to the sponsor.

A sponsor may ask to be identified to the recipient or remain anonymous. If JPH cannot reasonably identify the intended recipient or apply the sponsorship, we may contact the purchaser for clarification before applying the credit.

6. Cancellation

You may request cancellation through the customer portal or by contacting JPH support.

Cancellations submitted through the Customer Billing portal are ordinarily scheduled for the end of the current paid billing period. If you contact JPH support to request a different cancellation date, we will confirm what can be done before making a destructive change.

Cancellation stops future renewal. It does not necessarily delete your account immediately.

For ordinary customer-requested cancellations and terminations for nonpayment, JPH normally keeps the hosted account in a suspended state for 30 days after service termination before permanent deletion. This recovery window is intended to allow a recently ended service to be restored or reactivated when reasonably practical.

A customer may request earlier deletion. JPH may also delete or preserve data on a different schedule when reasonably necessary because of abuse, security incidents, legal obligations, upstream-provider requirements, or other urgent operational circumstances.

After the 30-day recovery window, the hosting account and active hosted data may be permanently deleted without further notice. Residual copies may remain temporarily in ordinary infrastructure backup rotations, but those backups are maintained for disaster recovery and are not guaranteed to be available for customer restoration.

Please make your own backup before requesting cancellation.

7. Refunds

New Hosting Accounts

New hosting customers may request a refund of hosting fees within 30 days of the initial purchase.

This guarantee applies to the first purchase of an eligible hosting service and does not restart when the customer changes plans, cancels and reorders, or creates another account.

Renewal Charges

If a hosting service renews and you did not intend to continue it, contact us within 7 days of the renewal charge.

We will generally refund that renewal and terminate the renewed service, provided that the account has not incurred significant resource costs, overages, abuse-related costs, or other unusual expenses during the renewed period.

Nonrefundable Items

Unless otherwise required by law, the following are not refundable:

If a third-party charge can be reversed without cost to JPH, we may choose to refund it even when these Terms do not require us to.

Nothing in this section limits refund or cancellation rights that cannot legally be waived.

8. Late or Failed Payments

If payment fails or an invoice remains unpaid, we may suspend affected services.

We will normally attempt to give the customer an opportunity to correct an ordinary billing problem before deleting hosted data.

Persistent nonpayment may result in termination and deletion of the account.

We are not required to preserve data indefinitely after suspension, cancellation, or termination.

9. Chargebacks and Payment Disputes

Please contact us before filing a chargeback if you believe a payment is wrong.

We are happy to investigate billing mistakes.

A chargeback or payment reversal may cause the affected service to be suspended while the dispute is investigated.

Fraudulent chargebacks or deliberate abuse of the payment-dispute process may result in account termination.

10. Customer Content

You retain ownership of content that you upload or create.

You grant JPH the limited rights necessary to store, transmit, copy, back up, restore, and otherwise process that content solely as needed to provide the service.

You are responsible for ensuring that you have the legal right to store and publish your content.

JPH does not claim ownership of customer websites, databases, virtual-airline data, documents, graphics, or other customer-created material.

11. Backups

JPH or its infrastructure providers may create automated backups or recovery copies of hosted accounts.

Unless a specific JPH plan expressly guarantees a particular backup service, these backups are provided as a convenience and disaster-recovery measure, not as the customer's only backup.

12. Security

JPH takes reasonable measures to protect its systems and customer accounts, but no internet-connected system is perfectly secure.

Where JPH performs work under an active Technical Management service period or separately agreed project scope, responsibility for the tasks specifically assigned to JPH shifts accordingly.

13. Resource Usage

Hosting accounts must remain within the resources and technical limits assigned to their plan and the reasonable limits of a shared hosting environment.

Occasional usage spikes are normal.

Activity that persistently consumes disproportionate CPU, memory, storage, database, email, bandwidth, or other shared resources may require optimization, restriction, or movement to a more appropriate plan.

Whenever practical, we will work with the customer before taking disruptive action.

Immediate restriction or suspension may be necessary when activity threatens server stability, security, or other customers.

14. Availability and Maintenance

We work to keep services available, but JPH does not provide a guaranteed uptime Service Level Agreement unless one is expressly included with the purchased service.

Service may occasionally be unavailable because of:

15. Support

Support is provided through the support methods JPH makes available.

Response and resolution times are not guaranteed unless a specific service states otherwise.

Support does not include work outside normal hosting provisioning, an active Technical Management service period, or a separately agreed project scope unless JPH agrees to perform it.

16. Acceptable Use

You must comply with the current JPH Acceptable Use Policy.

Serious abuse may result in immediate restriction, suspension, or termination when necessary to protect users, infrastructure, third parties, or JPH.

For less urgent problems, we generally prefer to contact the customer and provide a reasonable opportunity to correct the issue.

17. Copyright Complaints

JPH respects intellectual-property rights and maintains procedures for addressing properly submitted copyright complaints.

Repeated copyright infringement may result in termination of service.

18. Suspension and Termination

We may suspend or terminate service when reasonably necessary because of:

When the situation allows, we prefer correction over surprise deletion.

Some situations, particularly phishing, malware, attacks, child sexual abuse material, active compromise, or imminent harm to infrastructure, may require immediate action.

19. Discontinuation of a Service

We may stop offering a product or service.

If we discontinue an active paid service for reasons unrelated to customer misconduct, we will make reasonable efforts to provide advance notice and, where practical, assistance moving the customer or a refund or credit for unused prepaid service.

20. Disclaimer of Warranties

To the fullest extent permitted by law, JPH services are provided “as is” and “as available.”

We do not warrant that services will be uninterrupted, error-free, immune from attack, compatible with every application, or capable of recovering every lost file.

Nothing in these Terms excludes warranties or consumer rights that applicable law does not permit us to exclude.

21. Limitation of Liability

To the fullest extent permitted by law, Climb and Maintain, SPC and JustPlaneHosting will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from JPH services, including lost profits, lost business, or lost data.

Our aggregate liability relating to a JPH service will not exceed the amount you paid JPH for the affected service during the three months immediately preceding the event giving rise to the claim, except where applicable law requires otherwise.

This limitation does not apply where liability legally cannot be limited.

22. Indemnification

You agree to defend and indemnify Climb and Maintain, SPC against third-party claims arising from content or activity under your account when the claim results from your unlawful conduct, infringement of another person's rights, or material violation of these Terms.

This provision does not require you to indemnify JPH for JPH's own unlawful conduct or negligence where applicable law prohibits doing so.

23. Changes to These Terms

We may update these Terms as JPH changes.

Material changes will be posted with a new effective date and, when appropriate, communicated to existing customers.

Changes will not retroactively alter a completed transaction merely because doing so would be convenient for us.

24. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles.

Unless applicable law requires otherwise, legal proceedings concerning these Terms may be brought in the state or federal courts serving Spokane County, Washington.

Nothing in this section prevents either party from bringing an eligible matter in small-claims court.

25. Entire Agreement

These Terms, the Acceptable Use Policy, the Privacy Policy, the applicable order, and any plan-specific terms form the agreement governing the service.

If a plan-specific written term conflicts with these general Terms, the more specific term controls for that service.
